Allegations

It was alleged that in September 2018, the Member physically restrained a patient in an inappropriate manner, and that in July 2021, the Member struck a patient in the abdomen. It was also alleged that the Member failed to document his use of physical restraints with a patient.

Member’s Position

The Member did not attend the hearing and was deemed to have denied the allegations.

Discipline Committee’s Findings

A panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:

  • contravened a provision of the Nursing Act, 1991, the Regulated Health Professions Act, 1991, or the regulations under either of those Acts;
  • abused patients physically and emotionally;
  • failed to keep records as required; and
  • engaged in conduct or performed an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable and unprofessional.

Discipline Committee’s Order

The Discipline Committee directed that a further hearing be scheduled in order to determine an appropriate penalty flowing from the findings of professional misconduct.
