The Member was not present nor was she represented by legal counsel at the hearing. The hearing proceeded in her absence.

Facts

The patient was a resident at two group homes where the Member held supervisory roles. Among other things, the Member was dishonest with the patient and their power of attorney about the services that would be provided, failed to ensure that the patient was provided with adequate meals and that the patient was taking their daily medications, and failed to report medication compliance concerns to the patient’s power of attorney. The Member also failed to provide sanitary living conditions, failed to ensure unregulated staff were informed of the patient’s health condition and health care needs, failed to keep adequate records for the patient, including health and medication records, and failed to ensure the patient attended a scheduled medical appointment.

Discipline Committee’s Findings

A panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:

  • contravened a standard of practice of the profession or failed to meet the standards of practice of the profession;
  • abused a patient physically and emotionally;
  • failed to keep records as required; and
  • engaged in conduct, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable and unprofessional.

Discipline Committee’s Order

The Panel made an order that included the following:

  • an oral reprimand; and
  • revocation of the Member’s certificate of registration.

The Panel noted that there were numerous findings of professional misconduct which caused harm and broke the trust between the public and the Member. The Member’s breaches of the standards were multiple and thoroughly contrary to the values of the nursing profession which holds public trust, honesty, respect and integrity as cornerstones of the profession. The panel further noted that the Member’s lack of remorse or willingness to remediate as evidenced by her failure to attend the hearing demonstrate that the Member is ungovernable.
