The Member was not present, nor was the Member represented by legal counsel at the hearing. The hearing proceeded in the Member’s absence.
Facts
The Member prepared Vulnerable Sector Check request letters for herself and her sister with inaccurate information and using a colleague’s name without the colleague’s consent, and forged the colleague’s signature on the letters. The Member then provided the Vulnerable Sector Check request letters to the police service.
Discipline Committee’s Findings
A panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:
- failed to meet the standards of practice of the profession; and
- engaged in conduct or performed an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as dishonourable or unprofessional.
Discipline Committee’s Order
The Panel made an order that included the following:
- an oral reprimand;
- a 2-month suspension; and
- terms, conditions and limitations including:
- attending at least 2 meetings with a Regulatory Expert; and
- employer notification for 12 months.
The Panel concluded that the order was reasonable and in the public interest and was in line with what has been ordered in previous cases in similar circumstances.
