Facts

The Member admitted that he engaged in professional misconduct. While the Member was the only registered staff on a night shift at a long-term care home, the Member left the facility for approximately 30 minutes without notifying the on-call Registered Nurse that he was leaving the facility. At a different long-term care home, the Member failed to verify a medication order before updating a patient’s chart, failed to document a physician’s verbal order to discontinue medication, failed to document a conversation with a patient’s substitute decision-maker, and incorrectly advised or gave a patient’s physician the incorrect impression that a patient had palliative care orders.

Discipline Committee’s Findings

Based on the Member’s admissions, a panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:

  • contravened a standard of practice of the profession or failed to meet the standards of practice of the profession;
  • discontinued professional services that were needed without arranging for alternative or replacement services;
  • failed to keep records as required; and
  • engaged in conduct or performed an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as dishonourable and unprofessional.

Discipline Committee’s Order

The College of Nurses of Ontario (“CNO”) and the Member presented the Panel with a Joint Submission on Order requesting that the Panel make an order that included the following:

  • an oral reprimand;
  • a 2-month suspension; and
  • terms, conditions and limitations including:
    • attending at least 2 meetings with a Regulatory Expert;
    • employer notification for 12 months; and
    • meeting with a mentor for 8-12 months.

The Panel accepted the Joint Submission on Order, concluding that the proposed penalty was reasonable and in the public interest. 

The Panel noted that the Member cooperated with the CNO and accepted responsibility by agreeing to the facts and the proposed order.
