Facts

The Member admitted that he engaged in professional misconduct. The member was part of a healthcare team that triaged a patient with complex mental health conditions. Within a year of being discharged from the facility, the member and the patient began a personal and sexual relationship that included explicit text messages and telephone conversations and sexual intercourse on one occasion.  

In an unrelated incident, the Member approached a social worker student he had met earlier in the day at the facility, and said, “I want to fuck you”, or words to that effect. 

Discipline Committee’s Findings

Based on the Member’s admissions, a panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:

  • contravened a standard of practice of the profession or failed to meet the standards of practice of the profession; and
  • engaged in conduct or performed an act, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as dishonourable, disgraceful and unprofessional. 

Discipline Committee’s Order

The College of Nurses of Ontario (“CNO”) and the Member presented the Panel with a Joint Submission on Order requesting that the Panel make an order that included the following:

  • an oral reprimand; and
  • immediate revocation of the Member’s certificate of registration.

The Panel accepted the Joint Submission on Order, concluding that the proposed order was reasonable and in the public interest. The member had cooperated with CNO and accepted responsibility by agreeing to the facts and a proposed order.

The Panel noted that the order sends a strong message to all members of the profession that any findings of a sexual relationship with a patient will have significant consequences.
