Facts
The Member admitted that she engaged in professional misconduct while caring for infant patients in the neonatal intensive care unit of a hospital.
The Member handled infant patients roughly and/or carelessly, failed to adjust a patient’s oxygen levels after the patient returned to the unit, and falsely documented and reported to an oncoming nurse that she provided care to a patient that was not actually provided.
The Member was also overheard saying to infant patients, “if you parents loved you, they would let you die”, “better off dead” and “this is cruel, they don’t love you.”
In addition, the Member had numerous interactions with parents of infant patients that were culturally inappropriate, showed insensitivity and were disrespectful. On one occasion, the Member told a parent that their diapering technique could cause e-coli sepsis when the patient’s twin had recently died of e-coli sepsis. She told another patient’s parents that they knew nothing and needed help to understand, that they should not speak their own language to their baby and to speak English while at the baby’s bedside, for example. She was also overheard telling a patient’s parents false information about the patient’s demeanour to persuade the parents to attend the hospital.
Discipline Committee’s Findings
Based on the Member’s admissions, a panel of the Discipline Committee of the College of Nurses of Ontario (the “Panel”) found that the Member:
- contravened a standard of practice of the profession or failed to meet the standards of practice of the profession;
- signed or issued, in their professional capacity, a document that they knew or ought to have known contained a false or misleading statement; and
- engaged in conduct, relevant to the practice of nursing, that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional and dishonourable.
Discipline Committee’s Order
The Member signed an undertaking to permanently resign as a member of the College of Nurses of Ontario (“CNO”) and agreed not to apply for membership with CNO at any time in the future.
In light of the Member’s undertaking, the CNO and the Member jointly sought an order requiring the Member to appear before the Panel for an oral reprimand.
The Panel accepted the Joint Submission on Order, concluding that the proposed order was reasonable and in the public interest.
